Webradio from November 15, 2023: Purchase-sale in co-ownership

The web radio of November 15, 2023 focused on the challenges surrounding buying and selling in co-ownership. Remember that article 1068.1 of the Civil Code of Québec, resulting from Bill 16, will in the near future require greater transparency during a co-ownership transaction. The attestation document provided for in this article will address specific questions on the "state of the co-ownership", so that buyers can get out of the fog before acquiring an apartment held in divided co-ownership. The sellers, as well as their syndicate, will have to better inform them, so that the latter know what to expect and acquire with full knowledge of the facts.

Various questions arise in this matter: What are the duties and obligations of the owner selling a condominium apartment? Which are the responsibility of the buyer? And what are the obligations of the board of directors towards the prospective buyer and the co-owner seller? How to choose a real estate broker and a notary to ensure a safe transaction? What is the relevance of requesting a pre-purchase inspection?
