Definition : Trap

Dangerous situation involving the civil liability of a person, particularly in matters of falls, giving right to compensation for bodily injurymaterial or moral damage suffered by the victim. A person creating « trap » situation commits a fault and is responsible for the harm caused in this way. This legal concept requires the following conditions:

  • The situation that caused the injury was inherently dangerous;
  • The non-appearance of the danger due to concealment or camouflage;
  • The situation must be such that a normally prudent and diligent person is unable to notice the presence of a danger;
  • The situation must be unusual and surprising, considering all the circumstances.
