Definition : Resiliation

Act by which a lease ceases to have effect for the remaining duration. This may occur when the lessee (tenant) fails to fulfill their obligations towards the landlord or even towards other occupants of the building (e.g., non-compliance with the by-laws of the immovable). In the latter case, the syndicate of co-owners may, after notifying the landlord and the tenant, request the resiliation of the lease of a private portion when the tenant’s failure to comply with an obligation causes serious harm to a co-owner or another occupant of the building.
