Definition : Absenteeism (Divided co-ownership)

Absence of one or more co-owners from the meeting of co-owners, which hinders the proper functioning of this decision-making body and limits the participation of co-owners in collective decisions. It may also complicate reaching quorum, although the make-up meeting helps to address this issue.

A co-owner who is absent remains, in principle, bound by the decisions adopted during the meeting. However, their absence does not prevent them from exercising their rights, particularly to contest a decision under article 1103 of the Civil code of Québec.

Are we required to hold co-owners' meetings?

Our co-ownership consists of a small building with only three units. We don’t really feel the need to meet this year since there is nothing noteworthy to discuss, and we often talk informally in front of the building. Everything seems to be going smoothly. My neighbor, however, suggests that we should…...

My goal is to address this delicate issue…...
