Absence of one or more co-owners from the meeting of co-owners, which hinders the proper functioning of this decision-making body and limits the participation of co-owners in collective decisions. It may also complicate reaching quorum, although the make-up meeting helps to address this issue.
A co-owner who is absent remains, in principle, bound by the decisions adopted during the meeting. However, their absence does not prevent them from exercising their rights, particularly to contest a decision under article 1103 of the Civil code of Québec.
